President Buhari: sued over appointments

President Muhammadu Buhari has been dragged to court over the 25 appointments he made so far which excluded the South East geopolitical zone.
Dim-Udebuani Marcel, an Abuja based lawyer in suit no. FHC/ABJ/CS/732/2015, filed on 31st August, 2015, by his counsel Jude Ifesemen, the plaintiff wants the court to determine whether the total of over 25 appointments made so far by President Buhari is not against the spirit of section 14(3) of 1999 constitution as amended. The President and the Chairman, Federal Character Commission Were joined as defendants.
“Whether the exclusion of South East geo-political zone in the 25 appointments made so far by the 1st defendant is unconstitutional and divisive?
“Whether there are no qualified and credible or corrupt free persons from the entire South East zone?
“Whether the 2nd defendant has in the circumstance of this case, discharged its statutory duties under paragraph 8(1), (a), (b) and (c) of the Third Schedule to the 1999 constitution of the Federal Republic of Nigeria (as amended)”.
The plaintiff prayed the court for an order compelling the 1st defendant (Buhari) to reverse the appointments so far made to observe and comply with the principle of Federal Character as enshrined in the constitution of the Federal Republic of Nigeria 1999 (as amended).
He also sought an order of court compelling the 2nd defendant (Chairman, Federal Character Commission) to invoke paragraph 8(1) (c) of the Third Schedule to the 1999 constitution (as amended) and order of court declaring all the appointments so far made null and void for violation of the principle of Federal Character enshrined in the constitution.
The suit was supported with 23 paragraph affidavit deposed to by the plaintiff, Marcel.

Are these appointments of key government functionaries subject to confirmation hearings or are they final? Who is going to be the Umar Dikko of this bunch.
This guy is sick, at best sentimental. I am not a lawyer, but does the constitution states qualify any appointment(s), what does it say when, one, two, 10, 100 etc say? What of inn the life of an administration, does it have to be at the beginning, middle or end of an administration. Whether in the first or second term etc. An average Nigerian who has been paying attention to what is going on in terms of cabinet formation knows that, there’re hundreds of appointment to be made by President Buhari. The head of the federal character Commission is not consulted when appointments are made. Even if the Fed Character Commission is the Custodian of this section of the Country, it can’t do anything at this point since the president has not completed his appointments. Any Judge that entertains this should be benched by the appropriate supervisory agency, in this case, the National Judicial Service Commission. We should encourage people to bring reasonable Law suits not this kind of frivolous law suits. This guy is a local champion looking for cheap popularity. There’re a lot of them, remember another Ibo guy who sue Buhari for “lying” about his School Certificate? What happened? They’re same group/bunch of Ibo guys who couldn’t stand Buhari against their tribesman. I hate to describe as such, my audience, each time, Buhari moves one step, ten Ibo men starts barking and waggling their tail. Na only them go school to read law and the constitution? I weak oooh!!! Please, I beg to indulge in speaking pidgin, in case, they may understand better. I hope common reason will prevail and the wise amongst them will rise up and talk common sense. Its a cheap shot to start shouting marginalization for not getting their share of the National cake even before the party has yet to start. But others waited in pain while others were burying their loved ones when BK, kidnappers armed robbers or even those who lost their loved in a debilitated medical services all raised their urgly heads under the watchful eyes of Jonathan, an indigene of the SS/SE region. How about that, Dim Marcel? His argument now is that, it started before GEJ, yes or may be but it worsened under Jonathan. Good luck with your law suit but be prepared to pay damages in counter suite and/or Court costs.

Frivolous suit aimed at clogging up the public discourse with noise and distract from the serious work of recovering stolen commonwealth, fighting book haram and ending insecurity, and reviving the economy.
What damage does he, as a person incur from these appointments? And who should have been chosen that was not chosen, according to him? And who said the SE does not have incorrigible people?
