The Abuja division of Court of Appeal has unanimously dismissed appeal by Sir Friday Nwosu in which he asked to be declared the winner of Abia State PDP gubernatorial primary of December 2014 following the nullification of election of election of Governor Okezie Ikpeazu by Abuja division of Federal High Court.

Nwosu who came third in the primay  had claimed in the suit that Uche Ogah who came second did not sign the result sheet of the election.

Thus, Nwosu said he should be the beneficiary of the nullification of election of Ikpeazu and not Ogah as directed by the Court.

But the Appeal Court panel led by Justice Morenike Ogunwumiju said the  fact that failure of Ogah to sign the result of primary election did not take away his right to protest against it by approaching the throne of justice for redress.

Ikpeazu won the first appeal decided by the court.

The court is delivering judgment in the third appeal.
