Land grabbing: Court strikes out case against El-Rufai’s aide

Chief Magistrate court sitting in Kaduna on Friday struck out the land grabbing case brought before it by members of Gidan Daji Community,Chikun local Government in Kaduna against the Special Adviser to Governor Nasir El-Rufai on Political matters, Dr. Uba Sani.

The Gidan Daji Community had dragged Uba Sani to court over a controversial land, alleged to have been forcefully taken over by the adviser.

In the suit with number: Kad/206dc/15 filed at Chief Magistrate Court , Ibrahim Taiwo Road, Kaduna recently, the Community in a 15-count charges brought before Chief Margistrate, Awalu Musa Aliyu by Malame Legal Consult, on behalf of Gidan Daji community against the defendant,members of the community accused Sani of deploying seven trucks of armed policemen and and some government officials to invade the community,a suburb of Kaduna.

But in today’s ruling on the notice of preliminary objection on whether the Courts has the jurisdiction to hear the case or not , the Chief Magistrate, Awalu Aliyu said the court cannot hear the land grabbing case and therefore struck out the case on grounds of want of jurisdiction .

Reading the ruling , the Magistrate also pointed out that the complainants were not properly represented even if the case was to be heard.More so, that his court cannot hear land title cases.

Speaking to journalists after the ruling , counsel to members of the Gidan Daji community , Barrister Henry Obimba said as lawyers , they are trained to accept any court judgment .However , he said they would proceed to filed another case at the higher court .

According to Obimba , they are going to a higher court , because there is a need to fight and get justice for the downtrodden

Meanwhile, Uba Sani’s counsel, Abdulrauf Atiku commended the court for the ruling .adding that they had earlier raised and argued in a preliminary objection during the hearing that th case should be struck out for lack of merit and want of jurisdiction, which the court did. But Atiku however said , they are going to sue the complainants and alleged sponsors of the case.

Though Barrister Atiku didnt mention name , an aide to Uba Sani, Tonga Abdulrahaman said all complainants and alleged sponsors would be sued . ” We have tried to settle the case before it got to this point , but it didnt work , “We have discovered that Senator Shehu Sani is one of the sponsors of Gidan Daji Community case and we’re ready to sue him”.
